Ludum provides an online service that allows users to set up unique personal profiles and workout routines. In addition, users can be linked together through Ludum community. To enrich our users’ experience, we request and display some personal information to other users within the same club. Ludum users can change their profile information at any time and can control who can see their fitness results.

Ludum is owned and operated by Endurance Sports Research Limited. Registered as a limited company in England and Wales.

INFORMATION COLLECTED BY LUDUM AND USES THEREOF

Ludum collects user submitted information such as social networks’ identification codes that are used for signing up and logging in to Ludum or email address to authenticate users and to send notifications to those users relating to the Ludum service. Ludum also collects other profile data including but not limited to: name, age, metric preferences, geographical location, workout routes and places, and other personal fitness details.

Ludum also stores and may review and analyze the data users enter about workouts, exercise, and anything users choose to track and keep records of without written consent. The results of the analysis may be used for further developments of Ludum’s training and performance management system and published for scientific purposes and commercial activities. Subjects’ identities will not be revealed.

Ludum also logs non-personally-identifiable information including IP address, profile information, aggregate user data and browser type, from users and visitors to the site. This data is used to manage the website, track usage and improve the website services. This non-personally-identifiable information may be shared with third-parties to provide more relevant services to members. User IP addresses are recorded for security and monitoring purposes.

If an individual users has linked his/her account with a Team in Ludum, Ludum may provide user content, including personal information, to those nominated as Coaches and Administrators with the Team with which the account is linked.

CORRECTING/UPDATING OR REMOVING INFORMATION

Ludum users may modify or remove any personal information at any time by logging into their account and accessing features such as Edit Profile and Account Settings or contacting us.

COOKIES

Ludum uses cookies to store users’ preferences and to record session information, for purposes including ensuring that users are not repeatedly offered the same advertisements and to customize newsletter, advertising, and web page content based on browser type and user profile information. We do not link the information we store in cookies to any personally identifiable information users submit while on the site. Users may be able to configure the browser to accept or reject all or some cookies, or notify them when a cookie is set — each browser is different, so check the “Help” menu of your browser to learn how to change your cookie preferences — however, you must enable cookies from Ludum to use most functions on the site.

Ludum contains links to sites. Our site is not responsible for the privacy policies and/or practices on other sites. When linking to another site, a user should read the privacy policy stated on that site.

SECURITY

Ludum takes precautions to insure that user account information is kept private. We use reasonable measures to protect user information that is stored within our database, and we restrict access to member information to those employees who need access to perform their job functions, such as our customer service personnel, scientific research personnel and technical staff. Once we have received your information, we will use strict procedures and security features to prevent unauthorised access. Unfortunately, the transmission of information via the internet is not completely secure. However, we will do our best to protect your personal data, but we cannot guarantee the security of your data transmitted to our website and all data transfer actions will be at your own risk.

CHANGES IN OUR PRIVACY POLICY

From time to time Ludum may make changes to its privacy policy. In such case, Ludum will post changes on its web site to make users aware of what the changes are so users will always be aware of what information we collect, how we use it, and when we may disclose it. A user is bound by any minor changes to the policy when she or he uses the site after those changes have been posted. If, however, we are going to use users’ personally identifiable information in a manner materially different from that stated at the time of collection we will notify by posting a notice on our website for 30 days.

SPECIAL PRIVACY NOTE GOVERNING U.S. HIGHER EDUCATION

Ludum expressly acknowledges that student information or data for students affiliated with institutions of higher education in the United States to which it may have access under the Terms of Service is subject to the Family Educational Rights and Privacy Act (FERPA), 20 U.S.C § 1232g; 34 CFR Part 99. Ludum shall not use such student information or data in any way except pursuant to the Licensee’s instructions or to the extent necessary to perform services under the Terms of Service. Ludum shall not disclose any student information or data to any third party in any way except with the Licensee or the related student’s written consent. If Ludum subcontracts any part of its obligations hereunder, it will require such subcontractor(s) to comply with applicable privacy laws and regulations and will, prior to sharing any personal information with such subcontractor(s), require such subcontractor(s) to agree to be bound by written contractual obligations materially identical to those assumed by Ludum in this section.
